The Shop and Establishment Act regulates the shops and commercial establishments operating within the state. Every state has its own Shop and Establishment Act (“Act”). However, the general provisions of the Act are the same in all states. The Labour Department of the respective states implements the Shop and Establishment Act.
REGULATION UNDER SHOP AND ESTABLISHMENT ACT
The License is issued to the following establishments:
• Business
• Trade
• Professions Registered under the Shop and Establishment Act.
• The Shops and Establishment act makes sure that both organized and unorganized sectors are providing appropriate working conditions to the laborers. Such as the applicant (Establishment) has to file an online application concerning his state’s official portal.
PROCESS FOR OBTAINING SHOP AND ESTABLISHMENT REGISTRATION
It differs from state to state
- For obtaining the registration certificate online, the proprietor or owner of the shop or business must log into the respective State Labour Department website
- Upload the documents and pay the prescribed fees
- Once the registration form is approved, the registration certificate will be issued online to the proprietor or owner of the business.
DOCUMENTS REQUIRED FOR SHOP AND ESTABLISHMENT REGISTRATION
The documents required for obtaining the shop and establishment registration certificate are:
- Shop or Business establishment address proof.
- ID proof of the proprietor.
- PAN Card of the proprietor.
- Details of the employees.
- Payment challan.
- Additional business licenses necessary for starting the business, if any.

Fees of shop and establishment registration change state-wise For example- The fee for registering a shop or establishment under the Shops and Establishment Act in Delhi depends on the number of employees:
- 0 employees: ₹5
- 1–10 employees: ₹15
- 11–20 employees: ₹1,000
- 21–50 employees: ₹2,000
- 51–100 employees: ₹3,500
- 101 or more employees: ₹4,500
